Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Tapora Limited (“we”, “us”, “our”) governing your use of our mobile game Profit Rush: Money Clicker (the “Game”) and the website https://taporaltd.com (together, the “Services”).

By downloading, installing, or using the Game, you agree to these Terms and to our Privacy Policy (available at https://taporaltd.com/privacy). If you do not agree, do not use the Services.

1. Eligibility and age

You must be at least 13 years old (or the higher minimum age required in your country) to use the Game. If you are under the age of legal majority in your country of residence, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents and guardians are responsible for the activity of minors using the Game, including any purchases.

2. License to use the Game

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Game on a compatible device that you own or control, solely for your own personal, non-commercial entertainment.

You may not, and may not attempt to:

  • copy, modify, distribute, sell, rent, lease, or sublicense the Game or any part of it;
  • reverse engineer, decompile, or extract the source code of the Game, except where such restriction is prohibited by applicable law;
  • use the Game for any commercial purpose without our prior written consent;
  • remove or alter any copyright, trademark, or other proprietary notices.

Your use of the Game is also subject to the terms of the platform through which you downloaded it (Apple App Store or Google Play).

3. Virtual items and virtual currency

The Game may include virtual currency (such as coins or gems) and virtual items (together, “Virtual Items”) that can be earned through gameplay or purchased for real money.

You do not own Virtual Items. When you obtain Virtual Items, you receive only a limited, personal, non-transferable, non-sublicensable, revocable license to use them within the Game. Virtual Items have no monetary value, cannot be exchanged for real money, goods, or services outside the Game, and cannot be sold, traded, gifted, or transferred to any other person, except where a feature of the Game expressly allows it.

We may modify, rebalance, replace, or remove Virtual Items at any time as part of operating and updating the Game. Virtual Items are forfeited without compensation when your access to the Game is terminated or when the Game is discontinued, except where applicable law requires otherwise.

4. In-app purchases, payments, and refunds

The Game is free to play. It offers optional in-app purchases of Virtual Items for real money. All purchases are processed by the platform provider (Apple or Google) under its own terms; we do not receive or store your payment card details.

By making a purchase, you agree that the Virtual Items are made available to you immediately, and — to the extent permitted by law — you acknowledge that this means you lose any statutory right of withdrawal (“cooling-off” right) once delivery has begun.

All purchases are final and non-refundable, except where a refund is required by applicable law or granted under the refund policy of the platform through which you made the purchase. Refund requests for purchases made through the App Store or Google Play must be directed to Apple or Google respectively.

Prices of in-app purchases may change at any time. We may also offer time-limited items or promotions; their availability and content may change without notice.

5. Advertising

The Game is funded in part by advertising and may display advertisements from third parties, including optional rewarded ads that grant in-game bonuses. The content of third-party advertisements is the responsibility of the respective advertiser. How advertising partners process data is described in our Privacy Policy at https://taporaltd.com/privacy.

6. Rules of conduct

When using the Game, you agree not to:

  • use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software that modifies or interferes with the Game;
  • exploit bugs or errors for advantage, or fail to report a discovered exploit to us;
  • interfere with or disrupt the Game, its servers, or other players’ use of the Game;
  • sell, buy, or exchange Virtual Items or game accounts for real money or value outside the Game (“real-money trading”);
  • use the Game to violate any applicable law or the rights of any third party;
  • misrepresent your identity or your affiliation with any person or entity.

Violation of these rules may result in suspension or termination of your access to the Game without compensation (see Section 9).

7. Ownership and intellectual property

The Game and all of its content — including software, code, design, graphics, characters, names, text, music, sound effects, and Virtual Items — are owned by Tapora Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 2, no rights in the Game or its content are transferred to you.

8. Feedback

If you send us suggestions, ideas, or feedback about the Game, you agree that we may use them without restriction or compensation to you. We are not obliged to implement or respond to any feedback.

9. Updates, availability, and termination

Updates. We may update, modify, or change the Game at any time — including gameplay, balance, features, and Virtual Items — with or without notice. Updates may be required to continue playing.

Availability. We do not guarantee that the Game will be available at all times, in all territories, or free of interruptions. We may suspend or discontinue the Game, in whole or in part, at any time. Where reasonably possible, we will provide advance notice of a permanent shutdown.

Termination by us. We may suspend or terminate your access to the Game if you breach these Terms, if we suspect fraudulent or unlawful activity, or if we discontinue the Game. Upon termination, your license ends and any Virtual Items are forfeited without compensation, except where applicable law requires otherwise.

Termination by you. You may stop using the Game at any time by uninstalling it.

10. Third-party services

The Services may contain links to, or rely on, third-party services (including app stores, advertising networks, and analytics providers). We are not responsible for third-party services, their content, or their terms; your use of them is governed by their own agreements and policies.

11. Disclaimer of warranties

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits any mandatory statutory rights you have as a consumer.

12. Limitation of liability

To the maximum extent permitted by applicable law:

  • we are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, data, goodwill, or game progress, arising out of or relating to the Services;
  • our total aggregate liability for all claims relating to the Services will not exceed the total amount you paid us (through in-app purchases) in the six (6) months preceding the event giving rise to the claim, or, if you have made no purchases, the discontinuation of your access to the Game shall be your sole remedy.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Tapora Limited from any claims, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services.

14. Governing law and disputes

These Terms are governed by the laws of Hong Kong SAR, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the courts of Hong Kong SAR, unless the mandatory consumer protection law of your country of residence provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The current version is always available at https://taporaltd.com/terms. If we make material changes, we will notify you in the Game or by other appropriate means before the changes take effect. Your continued use of the Game after the changes take effect constitutes acceptance of the updated Terms.

16. General provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
